copyrighted material from your website/twitter (or anywhere else you

have used it) immediately.

Ms. Reiland:

I am writing to inform you that I believe the actions you took in taking

screenshots of my website/email and publishing them on your own on

Friday, October, 12, 2018 were in violation of both my copyright and the

Terms of Use (https://herautism.com/terms-of-use/) which incorporates my

Privacy Policy and Disclaimer which you explicitly agreed to upon

subscribing to my site.

The Terms of Use specifically state, “You will not modify, publish,

transmit, reverse engineer, participate in the transfer or sale, create

derivative works, or in any way exploit any of the content, in whole or

in part, found on the Website or any of the resources available for

download from the Website.” Your acts on Friday were in direct violation

of this provision.

In addition, the Terms of Use specifically notified you that “All

content included as part of the Service, such as text, graphics, logos,

images, as well as the compilation thereof, and any software used on the

Website, is the property of the Company or its suppliers and protected

by copyright and other laws that protect intellectual property and

proprietary rights.”

In this instance, the content you published on your site not only

contained my own content, but also contained a stock photo to which I

hold a license, but do not own. Per the terms of service of this vendor,

I have notified them of your use of the photo on your site and my

notification to you that you remove this content.

Again, I require that you remove any and all content from your site

published in violation of copyright law and my Terms of Use which

incorporates my Privacy Policy and Disclaimer.

In the event that you refuse to remove this content and we are unable to

resolve this matter peaceably between ourselves, I will be contacting

legal counsel to determine how best to proceed, and in fact, have

already taken steps to begin that process.

Please forgive me for missing this detail in my last email to you. The

second photo in the graphic you screen shot was also a stock photo and

not one to which I own ay rights. Please notice that I have not, nor

will I give you permission/authorization to publish content/images that

I do not own (or that I do own) and you publish it at your own risk.
